Sorry but think you are on thin ice , you come round a corner and see a car doing a 3 point turn so it is not safe for you to continue until the danger has past I E the car has gone away , the fact that he was slow to maneuver is no indication that he was giving you the right to ride across his path , hope you were ok , but as some one has already said ride defensively it is the only way , you are too vulnerable on a bike to do any thing else and survive

sorry if I sound like an old fart but I want you to still be riding and enjoying bikes when you are my age freferable with no broken bones and a cleen licence

So a car crashed into me this morning and I was wondering if anyone could tell me if i'm at fault or not. Basically what happened was I was riding around a car doing the last point in a three point turn. When I got to the front of the car I thought he saw me because he hadn't started pulling away and i continued riding he obviously didn't see a tall black bike and drove straight into the side of me and ****3d up my bike:( am I in the wrong or can I claim for the damages?

If you we're doing the 3 point turn at the time then it is you who is at fault. You should have taken more care of you surroundings. Unless the driver gave you direct eye contact and agreed to let you finish then it is your fault. It's the same if you're in a car. If someone comes whilst you are doing your manuever then you must make eye contact with them. It is there when you let them pass or they let you finish.

was he completely stopped? if he was completely stopped and pulled off into you i would say it was his fault

This is true. If his engine wasn't on then I can't see why it was your fault. However that said good luck proving that in court! At the end of the day it's my word against yours.

on what kind of road ?

was uou at a junction ?

why was you makeing the turn reason and aim ?

maybe draw us a little diagram of you the car and road with direction arrows ect

It really depends on discretion and where in the maneuver you collided. Either way it sounds like you were riding without thinking ahead unless he indicated left and made it clear he was pulling over to stop and not turn round, not saying your wrong but ride defensively it will end up saving your life.

But in reality it will just go 50/50 because it will just be an ongoing battle and they will decide to no longer pursue it.

Even if it was all in your favor and he did everything incorrectly you will have to go to heaven and hell to prove it I honestly don't see it happening.

If you genuinely were not speeding and you managed to get past it before it clipped it at the end you may have a chance though.

just tell them you ..... "i slowed wainting for the driver to finish his manouver, he stop checked his sourroundings and looked at you, there was a pause confirming in your mind he was allowing you past, he stayed still untill you where directly infront of him. my bike is very loud and i had my dipped headlight on so there was no confusion that i couldent be seen/heard. as a result of the incident my leg is hurting and i have been forced to take light juties at work. i am going to the doctor to see if there is any damage". stick tothat story 100% take back abit from the insurance companies that rob us.....

try ur luck and claim/ dont claim/ sned them ur money. what ever he does cal ur policy will increase and u will pay. better to pay for someone u know than someone ya dont.

Looks like it was more my fault then. It was on a side road just outside my school, not a junction. Thanks for the help guys, I do realise I shouldn't haven't taken the chance and really regret it now worst bit is I've had to put back on the ugly original tail light lol. Will take more care riding from now on :/
