The cdi that bolts to the oil tank is restricted and softens the power at peak rpm.You can't fit an older one to a new loom.You have to transplant the whole loom from an older model too.
If the bike is running poorly when hot then it could be the coil breaking down.
Is the regulator still connected? Unplug it and see if it runs better with this disconnected
Or it could be the choke is faulty in its operation.As the motor gets warm with choke engaged it will start to splutter and lose power
Also what is your mixture screw set at.It should be 1 1/2 turns out from fully closed

is the regulator the thing that is bolted on under the seat? i heard of ppls dtr's wheeling 2nd gear mine doesnt even wheelie in first unless you bounce it and pull it up so the oil tank cdi softens the power but how much slower does this make the bike compared to an older cdi which does not do this?

Its not so much slower its more that the power is delivered softer.I personally have found it harder to wheelie a newer model in 2nd.It should still pick up in first easy though.
The regulator is the ribbed metal box under the seat
I have changed the loom and cdi on my 01 for a pre '97 one and that picks up in 2nd just fine

what the front wheel lifts just off the engine in 2nd mine wont even in 1st with a 15tooth sprocket it will lift if you use the clutch but thats the only way you think a rejet would be worth doing as i derestricted the front pipe. also what does the regulator do?

It lifts in 2nd with a tug of the bars no need to clutch it up
Leave the carb settings stock as it is already suited for a derestricted motor
The regulator meters the voltage to the battery.If its faulty it is possible for it to cause running problems when it gets hot
